Terms of Service

1. Agreement to these terms

These Terms of Service (the “Terms”) are an agreement between you and RepFluent (“RepFluent”, “we”, “us”) governing your access to and use of the RepFluent websites, applications, and services (the “Service”). By creating an account, accepting an invitation to a workspace, or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to it.

If you do not agree to these Terms, do not use the Service.

2. The Service

RepFluent is a training tool for sales teams. Sales representatives practice voice-based roleplay calls against AI buyers built from material their organization provides, and receive qualitative coaching feedback. The Service processes voice audio and produces transcripts and AI-generated feedback as part of its core functionality.

3. Accounts and workspaces

You need an account to use the Service. You are responsible for the activity that happens under your account and for keeping your sign-in method secure. Workspaces are administered by the organization that created them; workspace administrators can invite, remove, and manage members and can access content created inside the workspace, including practice-call recordings, transcripts, and feedback.

4. Your content

“Customer Content” is anything you or your organization submit to the Service: company and product descriptions, buyer profiles, scripts, practice-call audio, and the transcripts derived from it. You and your organization retain all rights to Customer Content. You grant RepFluent a limited license to host, process, transmit, and display Customer Content solely to provide, secure, and improve the Service for your workspace.

You are responsible for Customer Content: that you have the rights to submit it, and that it does not violate law or the rights of others. If you record or upload audio of real conversations, you are responsible for obtaining any consents that recording laws in your jurisdiction require.

5. AI-generated output

The Service uses artificial intelligence to simulate buyers and to generate coaching feedback. AI output can be inaccurate, incomplete, or inappropriate for your situation. It is provided for training practice only and is not professional, legal, or business advice. Use judgment before relying on it, and do not treat simulated conversations as statements of fact about any real person or company.

6. Acceptable use

When using the Service, you agree not to:

• break the law or violate the rights of others;
• upload audio of people who have not consented where consent is required;
• attempt to probe, disrupt, or gain unauthorized access to the Service or to other workspaces;
• resell, sublicense, or provide the Service to third parties outside your organization without our written agreement;
• use the Service to build a competing product, or scrape or bulk-extract content from it;
• misrepresent AI-generated conversations as real recordings of real people.

7. Fees and billing

Parts of the Service may be offered free of charge and parts under paid plans. Prices, plan limits, and billing terms are presented when you subscribe. Paid subscriptions are billed in advance through our payment processor, renew automatically until cancelled, and — except where the law requires otherwise — fees are non-refundable. We may change prices with reasonable advance notice, effective at your next renewal.

8. Privacy

Our Privacy Policy explains what information we collect — including call audio and transcripts — how we use it, and the choices you have. By using the Service you agree to it.

9. Intellectual property

RepFluent owns the Service, including its software, design, and branding. These Terms do not grant you any rights to our trademarks or to the Service beyond the limited right to use it as described here. If you send us feedback or suggestions, we may use them without obligation to you.

10. Termination

You may stop using the Service and delete your account at any time. Workspace administrators may remove members from a workspace at any time. We may suspend or terminate access to the Service if you materially breach these Terms, if required by law, or if the Service is discontinued; where practical, we will give you reasonable notice. Sections that by their nature should survive termination (including Sections 4, 5, and 11–13) survive.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

12. Limitation of liability

To the fullest extent permitted by law, RepFluent will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to the Service. Our total liability for all claims arising from or related to the Service is limited to the greater of the amounts you paid us for the Service in the twelve months before the claim or one hundred US dollars (US$100).

13. Indemnification

If you use the Service on behalf of an organization, that organization will defend and indemnify RepFluent against third-party claims arising from its Customer Content or its breach of these Terms, to the extent permitted by law.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Courts located in Delaware have exclusive jurisdiction over disputes arising from these Terms, and each party consents to their jurisdiction.

15. Changes to these terms

We may update these Terms from time to time. If a change is material, we will give notice — for example by email or an in-product notice — before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
